WASHINGTON (AP) — The Supreme Court on Monday rejected an appeal from a former business partner of presidential son Hunter Biden who was seeking to overturn his criminal conviction for securities fraud. As is typical, the justices did not comment in leaving in place a federal appeals court ruling that reinstated the fraud conviction of Devon Archer. A lower court judge had earlier set aside a jury verdict that found Archer guilty of fraud and ordered a new trial. It was the second time the Supreme Court denied Archer's appeal. His conviction was overturned later that year before the court of appeals in New York reinstated it in 2020.

That should be no surprise considering that a consistent proponent of this inquiry was former President Donald Trump. I make that judgment based on my work as a scholar of impeachment and also as a practitioner who helped lead the first Trump impeachment and trial as counsel to the House Judiciary Committee. McCarthy bitterly — and now hypocritically — criticized former Speaker Nancy Pelosi for announcing the first Trump impeachment before a vote (she later scheduled one). That includes examples like the inquiry into President Richard Nixon and the second Trump impeachment. The proposed Biden impeachment is a revenge mission and nothing more.

But the testimony this week of Mr. Archer, a former Yale lacrosse player who has been convicted of federal tax charges, fell well short of that, shooting down a bribery allegation Republicans have long promoted and generally rejecting the idea that the elder Mr. Biden had any material involvement in his son’s business dealings. It was the latest instance of House Republicans promising far more than they could produce in terms of proof of their allegations against the president.

Special counsel Jack Smith's second indictment against Trump alleges he unlawfully tried to overturn his election loss to President Joe Biden in the 2020 election. One day earlier, a former business partner of Hunter Biden testified that the younger Biden put his father on the phone during business meetings about 20 times, according to U.S. House members. Numerous GOP lawmakers and other supporters of Trump were quick to link the timing of Archer's testimony to Smith's indictment. White House spokesman Ian Sams posted that Archer "appears to have actually testified that President Biden wasn't involved and didn't discuss their business dealings. As they did following his first federal indictment in June, Trump's defenders attacked Smith and questioned his credibility.
